Dear customer, we would like to inform you that the Terms of sale set out below indicate, with extreme clarity and in full compliance with current consumer protection regulations, the conditions and methods by which you can make your purchases online on the website www.elok.bike in an easy, safe, fast and convenient way, therefore we invite you to read and accept them in order to use all our online services.

1. GENERAL INFORMATION

Parties

Supplier: Lok IT SAS with registered office at 2, Avenue Nicolas Aussel, Antibes, 06160 - France (hereinafter also referred to as "Supplier"). Customer: the person identified by the data entered at the time of registration and acceptance of these general conditions and in this regard the guarantees referred to in article 9 are valid.

Subject

Through the website www.elok.bike, the Supplier makes a virtual shelf available to the Customer from which it is possible to view online and purchase the devices from the same products and related accessories and services. Each product / service is accompanied by a technical data sheet, which indicates its main characteristics in brief and the technical specifications. The Customer will be able to view the electronic catalog and the offers of the Supplier but will be able to access the purchase functions only by registering and accepting these conditions of sale and by entering the "username" (or User-ID) and "password for identification" that the system issues to each customer at the end of the registration.

Nature of the relationship and cases of non-applicability of consumer protection regulations.

Each purchase transaction will be governed by the provisions of Legislative Decree 97/7/CE of 20/05/1997, Legislative Decree 206/05; the information aimed at the conclusion of the contract will be subject to art. 12 of Directive 2000/31/CE and, as regards the protection of confidentiality, will be subject to the legislation referred to in Regulation (EU) 2016/679. In compliance with the provisions of the national and community laws currently in force, the economic relationship between the Supplier and the Customer is governed by the consumer protection legislation exclusively in the event that the Customer purchases for personal purposes unrelated to their work. Therefore, the consumer protection regulations do not apply to the relations between the Supplier and the Customer who purchases for purposes related to their work by providing their VAT number, including in particular Directive 97/7/CE (contracts concluded in distance), Directive 85/577/CEE (right of withdrawal) and Directive 2005/36/CE (consumer code).

Prices

Unless otherwise indicated in writing, all prices indicated are "VAT included" in the section dedicated to individuals and "VAT excluded" in the business section and expressed in Euro. The validity of the prices indicated is always and only that indicated by the procedure (quote or cart) at the time of placing the order to the Supplier.

Payment

Payment is made by credit card through a primary credit institution that guarantees maximum security, confidentiality and correctness in transactions or through the Paypal payment system. Credit card payment procedures take place in a secure environment directly on the Bank or Paypal servers, without being processed by the website www.elok.bike. The Customer is informed that the Supplier, having carried out the appropriate checks, proceeds to withdraw the amount on the day of the order confirmation. Contracts for the sale of products on the website www.elok.bike are considered concluded at the time the purchase order placed by the customer is received by Lok IT SAS and the latter accepts it. Lok IT SAS will promptly send the customer a receipt of the purchase order made by the customer. The customer, by sending his purchase order electronically, declares to have read and accepted these general terms and conditions and undertakes to observe and respect them in his relations with Lok IT SAS.

2. PROCESSING OF PERSONAL DATA

Lok IT SAS pursuant to art. 13 of 95/46 / EC informs that the personal data acquired in reference to the commercial relationships established, provided directly by the interested parties, or otherwise acquired in the context of the company's activity, and in particular the data relating to the localization of eLOK devices, will form object of treatment in compliance with the aforementioned legislation, including the confidentiality obligations envisaged by these. In relation to the aforementioned, the rights referred to in Article 7 of 95/46 / EC may be exercised. The buyer is required to use the purchased products in accordance with the law in force, and in particular with the rules on confidentiality.

3. CUSTOMER OBLIGATIONS

The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance. Finally, the Customer is required, once the online purchase procedure has been completed, to print and keep these general conditions of sale, already viewed and accepted during the conclusion of the contract.5. 4. PURCHASE METHOD

The customer purchases the product, the characteristics of which are illustrated online in the relative descriptive and technical sheets, at the price indicated therein, to which the delivery costs specified on the site and any costs for cash on delivery are added. Before submitting the purchase order, the unit cost of each selected product is summarized, together with the total cost in the event of the purchase of multiple products and the relative delivery costs. Once the purchase order has been forwarded, the customer will receive from Lok IT SAS an e-mail message confirming the receipt of the purchase order and containing information relating to the main characteristics of the purchased good, a detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general terms and conditions, the detailed privacy policy and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site.

5. PRODUCTS DELIVERY

The purchased good, together with the relevant invoice, is delivered by courier to the address specified by the Customer at the time of the online order. Any specific needs must be proposed by the customer to Lok IT SAS at the time of placing the order. Lok IT SAS guarantees delivery of the goods within 15 (fifteen) working days from the date of receipt of the confirmation of the transaction. If Lok IT SAS fails to guarantee delivery within the aforementioned terms, an additional 10% discount will be applied to the total cost of the reference Lok IT SAS items. In case of non-delivery due to the absence of the recipient, at the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (Lok IT SAS).

The products purchased on the www.elok.bike site are subject to the regulations on the sale of consumer goods. The delivered products comply with the characteristics illustrated online in the relative descriptive and technical sheets and Lok IT SAS is liable to the customer for any lack of conformity existing at the time of delivery of the goods. Lok IT SAS guarantees its products for a period of 24 months from the date of activation of the same through the appropriate operations center. The guarantee is granted exclusively to the end user. 6. CONFORMITY GUARANTEE AND DEFECTIVE PRODUCTS

The goods must be returned to Lok IT SAS complete with all accessories, instruction manuals and everything originally delivered to the customer, as well as packed in its original packaging. A copy of the electronic order receipt must be attached to the product returned under warranty. The costs of returning the goods to Lok IT SAS are charged to the customer.

The procedure takes place in two stages:

  • sending the product return authorization form (RMA) to Lok IT SAS, using the appropriate form that can be downloaded from the site;
  • the supplier, once the form has been received, will send the appropriate authorization with the instructions for sending, via a traceable system, the product being returned. Upon receipt of the non-functioning product, the Supplier checks its conditions and assesses whether it is actually possible to replace / repair the product, with shipping costs borne by Lok IT SAS, or if the guarantee must be considered not applicable. Lok IT SAS does not provide any guarantee regarding coverage by GPS and telephony services as they are not provided by the same but by third parties.

7. GUARANTEES GIVEN BY THE CUSTOMER

The Customer guarantees, assuming all inherent responsibility and holding the Supplier harmless from any detrimental consequence, that his / her data, provided upon acceptance of these general conditions, are true and allow to identify the true identity of the Customer himself. it also undertakes to immediately inform the Supplier in writing, including by e-mail, of any changes in the data provided. At the time of registration, the Customer is assigned a subscriber identification code (User Name or UserID) and a keyword (Password) whose joint use will identify the Customer and allow the latter to make purchases online on the website www.elok.bike The Customer is therefore informed of the fact that purchase orders issued through the joint use of UserID and Password are valid and binding and that the availability of both by third parties would allow the latter to issue regular orders that bind the Customer, identified by UserID and Password, to accept receipt of the ordered goods and to pay the amount due. The Customer is therefore required to keep both the identification code and the password with the utmost diligence, keeping them both secret for the entire duration of the relationship with the Supplier. The Customer is also informed of the need to communicate a valid e-mail address to the Supplier in order to allow the Supplier to forward the order confirmations and any communication.

8. RIGHT OF WITHDRAWAL

The consumer has the right to exercise the right of withdrawal from any contract concluded with Lok IT SAS, without any penalty and without specifying the reason, within 10 (ten) ten working days from receipt of the goods. The right of withdrawal is recognized in the consumer in relation to any goods purchased by him on the website www.elok.bike

9. WITHDRAWAL RIGHTS METHOD

The right of withdrawal is exercised by sending, within the aforementioned term, a written communication to the address of Lok IT SAS by registered letter with acknowledgment of receipt. The notice of withdrawal can be sent, within the same term, also by telegram or fax, provided that it is confirmed by registered letter with return receipt within the following 48 hours. If the goods have been delivered, the customer is required to return it to Lok IT SAS within 15 (fifteen) working days from the date of delivery of the goods. The goods must be returned to Lok IT SAS complete with all accessories, instruction manuals and everything originally delivered to the customer, as well as packed in its original packaging. The returned product must be accompanied by a copy of the electronic order receipt. The costs of returning the goods to Lok IT SAS. are the responsibility of the customer. If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Lok IT SAS is required to reimburse the sums paid by the customer. In particular, Lok IT SAS will proceed free of charge to the transmission of the re-credit order relating to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the exercise of the right of withdrawal by the customer. This operation will be carried out through the credit card issuing institution of the credit card used for payment or by crediting the sum to the bank account indicated by the customer. 10. EXCLUSION OF THE RIGHT OF WITHDRAWAL

11. EXPRESS TERMINATION CLAUSE

In the event of total or partial failure to pay the purchase price of the asset, Lok IT SAS reserves the right to declare this contract terminated pursuant to and for the purposes of EU Directive 2019/771 by sending a written communication to the customer's electronic address.

12. COMMUNICATIONS

The Customer accepts that the notification and communications relating to all online services (including those relating to purchase orders) are made by the Supplier in electronic format and e-mail (electronic mail) and via Web service, recognizes their full validity and expressly waives as of now to disclaim the content of the declarations sent and / or received in electronic format. 14. APPLICABLE LAW AND JURISDICTION

This contract is governed by European law. The exclusive jurisdiction and forum for any legal action brought by the Buyer under this warranty or any further legal guarantees will be the Court of Antibes. If the Buyer is a consumer, the Court of the place where he has his residence will have jurisdiction.

15. REFERENCE

Although not expressly provided for in this contract, the law of France applies exclusively.
